In a recent hearing concerning the Amateur Kabaddi Federation of India (AKFI), the Supreme Court of India emphasized the necessity for robust measures to ensure integrity, fairness, autonomy, and independence in the election processes of sports federations across the nation. The Court underscored the importance of eliminating individuals who have monopolized these federations for personal gain.

The bench, comprising Justices Surya Kant and N. Kotiswar Singh, expressed concern over a letter from the self-proclaimed President of the Asian Kabaddi Federation to the AKFI, noting its offensive content. The Court inquired with Solicitor General Tushar Mehta about the feasibility of initiating a Central Bureau of Investigation (CBI) probe, potentially involving INTERPOL, and exploring diplomatic avenues to address disputes related to the federation’s recognition.

The Court remarked, “Taking into consideration the oral submissions made on behalf of the intervenors and the learned Administrator, and also having taken cognizance of the offensive language used by the purported and so-called President of the Asian Federation, it seems to us that some strong measures are required to be taken in order to infuse purity, fairness, autonomy, and independence in the election process, particularly to oust such persons who have monopolized the sports federation for their vested interest.”

This observation arose during the hearing of a writ petition filed by athletes Priyanka and Pooja, who sought permission to participate in the Asian Kabaddi Championship scheduled in Iran from February 20 to 25. Their participation was in jeopardy due to the suspension of the AKFI by the International Kabaddi Federation (IKF), which the petitioners alleged is merely a private entity registered in India without official government recognition. They contended that while the AKFI holds recognition from the Ministry of Sports and Youth Development, the IKF does not.

In response, the Supreme Court directed the Solicitor General to promptly obtain instructions on four critical points:

1. Diplomatic Resolution: Explore diplomatic channels to resolve conflicts concerning the recognition of sports associations, with an immediate focus on the Kabaddi Federation of India.

2. Investigation Mechanism: The Director of the CBI is to propose an effective investigation mechanism for both domestic and international probes, potentially involving international agencies such as INTERPOL, into the affairs of the sports federation.

3. Athlete Participation: Ensure that kabaddi players and other athletes are permitted to participate in international competitions, including the upcoming Asian Kabaddi Championship in Iran.

4. Election Process: Implement measures to guarantee that the election processes of sports federations are conducted with purity, fairness, autonomy, and independence, thereby removing individuals who have monopolized these federations for their vested interests.

The Supreme Court’s intervention highlights the pressing need for reform within India’s sports administration. The AKFI has faced scrutiny over allegations of being dominated by a single family, leading to the Delhi High Court appointing an administrator to oversee its operations and ensure compliance with the National Sports Code.
